This Friday (10/25), the Renegotiation Agreement was officially signed in a ceremony at the Palácio do Planalto, establishing the new fundaments for the actions to repair and compensate for the damages resulting from the collapse of the Fundão dam.
New Agreement: a commitment to repair and compensate for social, environmental and economic damages
The new R$170 billion agreement establishes guidelines for Samarco and the Public Authorities to continue with the completion of the proceeding in a complete and definitive manner.
Part of the resources will be allocated to the public authorities for actions focused on health, education and environmental sanitation. Another part will be executed by Samarco in the actions for compensation, resettlement and environmental reparation.
Who signs the document?
The R$170 billion agreement was reached between Samarco, Vale and BHP Brasil (“Shareholders”), the Union, the Regional Federal Court of the 6th Region (TRF6), the Governments of Minas Gerais and Espírito Santo, the Court of Justice of Minas Gerais, the Federal and State Prosecution Services and the Public Defender’s Offices of the Union and States (MG and ES). The Renova Foundation signs the document as an mediator/consenting party.

R$ 38 billion | invested until September 2024 through the Renova Foundation, in actions distributed across 42 programs with progress to date. |

Pillars of the New Agreement
Indemnity
- Fulfil the compensation definitively.
- Fulfil existing compensation programs run by the Renova Foundation.
- Pay the amount due in advance for those affected who have active AFE (Emergency Financial Aid).
- Pay, in a single installment, the amount equivalent to the active Loss of Profit.
- Create the Definitive Indemnity Program, as a last opportunity for compensation for those who received a negative response and/or were not included in any of the existing programs. Those affected must voluntarily join the PID after receiving a negative response or withdrawing their application from other existing programs.
Resettlement
- Finish the resettlements and final delivery in Novo Bento Rodrigues and Paracatu.
- The last constructions will be developed together with those affected and will be monitored by MPMG and technical advisors.
- In the district of Gesteira, completeness was achieved with the collective agreement approved in May 2023 and the transfer of R$126 million.
Environment
- Continue compensatory actions in the impacted sections along the Doce River Hydrographic Basin.
- Compensatory reforestation of 50 thousand hectares and management of the impacted area.
- Completion of the recovery of 5 thousand springs, restoration of banks and the aquatic environment, and sanitation and water quality in the basin.
- Creation of indicators to ensure transparency in meeting goals.
- Contaminated Area Management (CAM) to assess environmental quality and investigate potential contaminated areas.
- Feasibility studies for additional sediment removal from the Risoleta Neves Hydroelectric Power Plant (Candonga).
- Integrated Environmental Recovery Plan approved by the authorities.
Transition
The gradual and planned transfer of the actions carried out by the Renova Foundation to Samarco will be carried out to conclude the process definitively and fully.
