NEW INDEMNITY SYSTEM IN BAIXO GUANDU

The Renova Foundation is implementing a new indemnity system, which the Judiciary instituted as an alternative for full and definitive indemnity of the damages directly caused by the Fundao dam collapse to those affected in the municipality of Baixo Guandu (ES). The new platform will be available on the Foundation’s website (www.reparacaobaciariodoce.com) starting this Saturday, August 1st.

The new platform was created based on the decision by the 12th Federal Civil and Agrarian Court of the Judicial Section of Minas Gerais for a claim brought forward by the Commission of Affected Parties from Baixo Guandu for the resolution of Priority Axis 7 – Registration and Indemnity.

The Renova Foundation emphasizes that the system is an additional option for those affected. Indemnity can also be claimed through the Mediated Indemnity Program (PIM) currently in effect, following the eligibility criteria and indemnity parameters applied by the Renova Foundation, or by filing an individual action.

The defined period for the affected person to opt (or not) for the new online platform is from August 1st, 2020, through October 31st, 2020.

The new online indemnity platform is exclusively designated for the use of lawyers representing affected parties, who must fulfill the requirements required at each stage of the process, such as the presentation of documents. After submission through the online platform, the documents will be evaluated by the Renova Foundation. It means that the submitted documents will not be validated automatically. After completing all steps and accepting the proposal, the term of the individual agreement will be forwarded to the Court for approval and subsequent payment.

Since October 2019, the Renova Foundation has participated in hearings at the 12th Federal Court in Belo Horizonte, together with its maintainers Samarco, Vale, and BHP, to define priority actions within the Doce River reparation process. By judicial decision, 12 priority pillars were established, in which the Renova Foundation is already operating and which are now underway under the supervision of the Court.

The Renova Foundation understands that the negotiations are in line with meeting society’s needs in a fair, full, and satisfactory manner and resolving the actions related to the Fundao dam collapse.

As of June 2020, R$ 9 billion has been allocated to integrated reparation and compensation actions. Approximately R$ 2.54 billion has been paid in indemnities and emergency financial aid to about 321 thousand people.
